Senator Jeffries moved to amend the amendment on page 7, section 14, lines 52 through 62, by striking out all of subsection (h) and inserting lieu thereof a new subsection (h) to read as follows:
(h) Minor Modifications. -- Notwithstanding any provision of this article to contrary, a county commission may amend the order creating an economic opportunity development district to make, and may make, modifications to the boundaries of the economic opportunity development district without holding a public hearing or receiving approval of the executive director of the West Virginia Development Office or authorization by the Legislature if the modifications do not increase the total acreage of the economic opportunity development district or result in a change to the base tax revenue amount result in an increase to the acreage of the district of greater than ten acres annually: Provided that no district may increase the net acreage of the district pursuant to this subsection by greater than fifty acres over the life of the district. Any modifications made pursuant to this subsection, whether it be the addition of acreage that results in a net increase of acreage in the district or the swapping of acreage that does not result in the net increase of acreage, shall require a recalculation of the base tax revenue amount in the same manner as provided for in this section. The county commission is authorized to levy special district excise taxes on sales of tangible personal property and services made from business locations within the modified boundaries of the economic opportunity development district.
